The person who attacked first. If 你 get attacked then 你 have a right to defend yourself 由 any means necessary. Even smaller things like robberies can turn life threatening. The one who is being attacked doesn't know the attacker's intentions. If someone attacked me I'd automatically assume that they were going for murder.
