I think it can be used to disable people who are being threatening. I don't think pepper-spraying sit-down protesters is appropriate, but if they are getting aggressive, then sure, spray 'em.
Now if they use they better have a good reason to use it like if someone refuses to move (if you touch them, people will sue) or if they are a threat. The closeness of the spray to the persons face should also be taken into consideration, the closeness of the spray should correlate the the level of danger but just randomly because you don't like someone, no.
Not in this political climate. I think that with police brutality on the rise, it's a risk. It's better than bullets, yes. But more often than not excess force is used and lately things like tear gas and pepper spray are being used inappropriately and against non-violent protesters.
