There was an article on this in the newspaper! It was about a lesbian couple who were doing some BDSM stuff including asphyxiation. The one being asphyxiated had given her partner permission to, and while she was passed out, they had anal sex.

The law in their area says it was illegal because you are not allowed to give permission in advance of a sexual act, even though afterwards, the passed out woman was fine and didn't retract her permission.
