I am not a lawyer and know no 更多 about law then what I have seen on crime serials and read in old P.I. novels. However because this topic is still an area of much discussion both in our modern culture and 更多 importantly in this fandom I will try to keep my arguments within the confines of the rulebook that our justice system has labored to perfect for so long.

The 问题 is of course "Is killing ever justified". It is a 问题 that raises it's head at least ones in any serious 辩论 started at this club. The act of murder weather it is committed 由 one character 或者 another always has it's defenders and prosecutors and both have strong arguments for there respective sides.

During this 文章 I'm going to take some of the most 流行的 cases and using my limited understanding of the law (with the assistance of legal-dictionary.thefreedictionary.com) as well as my 更多 extensive study of the OUAT debates and discussions on this topic and act as judge.

Case #1- Homicide of Graham, sheriff

Defendant: Regina

Defendant held victim in captivity against his will for unknown years due to a breach of contract. Most likely due to Stockholm Syndrome both parties became emotionally involved. When victim attempted to break free defendant reacted to the perceived betrayal 由 killing him.

Defendants Argument: Grahams murder was a crime of passion done in the spur of the moment 由 a damaged and heartbroken woman who could not 熊 the thought of losing him and who obviously shows grief and remorse for what she felt she had to do.

Plea: Crime of Passion / Temporary Insanity

Judge's Statement: While the defendant may have loved the victim crimes of passion do not excuse murder it merely eliminates premeditation. (See: link) However the forced imprisonment of victim leading up to the crime as well as other crimes perviously committed against the victim (assault, rape) do prove malice aforethought. (See: link) It addition to all this defendants charge would automatically be bumped up to first degree for killing a police officer. (See: link)

Verdict: Guilty - First Degree Murder

Case #1- Homicide of Milah, wife

Defendant: Rumplestilskin

Victim (wife of defendant) committed adultery and abandoned her husband and son. When defendant learned of this betrayal he murdered her and assaulted her lover leaving him permanently crippled.

Defendants Argument: After suffering such injustices and humiliation at the hand of this woman the defendant asked her to explain herself and received only 更多 insults. At that moment all the suffering she had put him and his child though welled up inside him and he snapped.

Plea: Honor Killing / Infidelity, Crime of Passion / Temporary Insanity

Judges Statement: While honor killings as a result of infidelity may be an acceptable excuse for murder in countries where woman are viewed as property I would hope this fandom is above that sort of thinking. (See: link) Once again crimes of passion do not excuse murder merely eliminates premeditation and infidelity at least in most civilized countries is not a capital offense. (See: link)

Verdict: Guilty - 秒 Degree Murder

Case #1- Homicide of Cora Mills

Defendant: Snow White

Defendant when of sound mind planned and coordinated the murder of the victim in order to avenge past crimes committed 由 the victim as well as prevent any future crimes. In a spur of the moment adaption to the plan defendant used the victims own daughter as a proxy to deliver the killing blow.

Defendants Argument: Snow already knew what Cora was capable of doing and had to stop her before she killed her and everyone she loved.

Plea: vigilante justice / self defense

Judges Statement: Weather Cora deserved to die 或者 not does not matter. Vigilante justice is not protected under the law. (See: link)The only people allowed to dish out justice are those who were appointed to do so and only after all procedures are met. As the victim was not posing an immediate threat to her person the defendant can not plea self defense. The appropriate course of action would have been to leave the apprehension of the victim to someone without a conflict of interest that was qualified to administer justice in an appropriate manner. (See: link)

The complexity of this crime proves that it was premeditated. The brutality of the plan also adds to it severity. (See: link) The defendants clean record as well as her obvious remorse and eleventh 小时 attempt to stop the crime do work in her favor, however...

Verdict: Guilty - First Degree Murder

Case #1- Homicide of Royal Guard

Defendant: David "Charming"

During a 首页 invasion and attempted assassination/kidnapping defendant stabbed and killed the victim.

Defendants Argument: Charming was protecting himself and his family from someone that was threatening immediate bodily harm.

Plea: Self Defense

Judges Statement: There is really only one acceptable excuse for taking someone life in the eyes of the law and that is when someone is attempting to kill 或者 seriously injure 你 或者 someone else (See: link). Self defense does not however excuse 你 from the emotional ramifications of taking a life which can be 更多 unbearable then any justice a court can dish out.

Verdict: Acquitted - Self Defense

I may have appointed myself judge but as most of 你 know it is not the judge that has the last word but the jury. i'd like to issue 你 all a summons and invite 你 to deliberate on these cases in the comments.

For your benefit I've compiled some of my research in an link.

I'm sure many people know I ship CaptainSwan, but I will try to keep this 文章 as unbiased as possible and will enter a mental neutral zone.

It's unfortunate, but I see a lot of negative encounters between SwanFire shippers and CaptainSwan shippers. 更多 negative than positive, too. Can this be changed? I think so. How? Respect.

But to clarify on what's respectful and what's disrespectful, here are some examples:

Respectful

"I think Neal and Emma would make a good couple because they have similar backgrounds and they've been through a lot."

"I don't think Emma and Neal would make a good couple...

It has come to my attention that some people (SwanFire shippers, it usually seems) genuinely don't understand why the CaptainSwan ship even exists. And I just want to say, before I get started, that it is not my intention to start a ship war between CaptainSwan and SwanFire. The intention of this 文章 is not to convert SwanFire shippers, but to help them understand where some CaptainSwan shippers might be coming from.

This 文章 is not intended to speak on behalf of all CaptainSwan shippers because while we agree on the Emma x Hook relationship, we may not all be on the ship for the same...

After 阅读 katarlover's 文章 I made this long 评论 about it. I asked him if he minded if I 发布 the response as a separate article--he 说 yes, so here we go. I tried to be respectful about it, feel free to agree 或者 disagree, just be respectful about it.

I can agree to some extent that she's a hypocrite, but not for that reason. I feel like that is 更多 so denial and a twisted sense of justice. At that point she was totally (by some faltered mental state) convinced she was in the right, and that she really wasn't evil. In the most 最近的 season she admits that she's wrong many times;...

People seems to have a lot of issues with Emma and some of the choices she made. She has never been a favourite character of mine but I really feel dreadful for her. She was forced into a lot of shitty situations where she had to make terrible decisions and generally always chooses to do right 由 other people even if it will bring her heartache.

Starting at the very beginning, one of the main things that Emma did that people use against her is her giving up Henry. I've seen her called a terrible person, a bad mother, and all sorts of things because of this and the kicker? She didn't have a choice!...

**•Lana Parrilla Talks About Regina Teaching Emma Magic, Their Developing Relationship & Her Own Adeventure In Neverland!•**

Regina's seemingly strong dislike of Emma:
"It was never a personal hatred Regina had for Emma, she was a threat. Regina wanted to stop her from taking Henry. She did extreme things to stop this extreme threat of losing her son for good. It wasn't a personal vendetta, but it was the risk of losing the thing that meant everything to her, Henry."

"Now that she is working with Emma, Hook (and the Charmings) to get Henry back. Regina & Emma call themselves "the Moms"...

The Boy Who Ran Away 或者 the story of Bealfire

It all started with a boy that had 迷失 his father. This was not uncommon at that time because the country was at war, but he had not 迷失 his father in the war as the other boys had. He had 迷失 him to a great darkness that had consumed all that was good in his father, all that he had loved. This darkness went 由 the name of magic.

The father that had loved him, cared for him, comforted him when his mother had been killed was gone. Magic had killed him 或者 was killing him and replacing him with a cruel man filled with hate that hurt everyone around...
